Your Right to Cancel

Your right to cancel your order begins when your card is charged and lasts 14 days from the day you receive your goods. If your order includes multiple goods, the 14-day cancellation period starts from the day you receive the final batch.

Returning Goods

To return goods for a refund, you must first email us to obtain a return number. You have 14 days from receiving the return number to send the goods back. You are responsible for the cost of returning goods, and you should keep proof of postage.

Getting a Refund

Refunds will be processed within 14 days of cancelling your order. For returned goods, the refund will be issued within 14 days of us receiving the goods back.

Interpretation

  1. In this document:
    • ‘Basket’ refers to the electronic shopping basket on the Website for adding products.
    • ‘Buyer’ or ‘You’ means the person or their agents requesting the sale of Goods or using Our Website.
    • ‘Carrier’ refers to Us or the delivery agent responsible for delivering the Goods.
    • ‘Conditions’ are the Terms and Conditions in this document, binding once We accept Your Order.
    • ‘Contract’ is the agreement formed when We accept Your Order for the sale of Goods.
    • ‘Delivery Date’ is the date the Goods are delivered to You.
    • ‘Goods’ are products available for purchase on the Website.
    • ‘Heating Appliance’ includes fuel-consuming products like Gas Boilers, Oil Boilers, Gas Fires, Gas Water Heaters, and Gas Wall Heaters.
    • ‘Information System’ is a system for generating, sending, receiving, storing, or processing electronic communications.
    • ‘Order’ is the electronic form You submit, listing Goods, prices, billing and delivery addresses, phone number, and email.
    • ‘Order Acceptance’ indicates the Order is verified, and Goods can be dispatched.
    • ‘Order Received Date’ is when the Order enters Our Information System for review.
    • ‘Our’ refers to the Seller.
    • ‘Payment’ is the transfer of funds from You to Us.
    • ‘Payment Card’ is the credit, debit card, or other payment system You choose for the Order.
    • ‘Personalised Goods’ are products made to measure or altered to specific requirements.
    • ‘Regulations’ refer to the Consumer Contracts Regulations 2013.
    • ‘Rejection of the Order’ means the Order is rejected and will not be processed.
    • ‘Shipping Charge’ covers order picking, packing materials, and delivery by the Carrier.
    • ‘Standard Delivery Area’ includes England, Wales, Scotland, and Northern Ireland.
    • ‘Seller’, ‘We’, ‘Us’ refers to Sks Ilford Limited, Company Number: 6216887, VAT Number: 331 0384 44, Registered Address: 424-426 Green Lane, Ilford Essex IG3 9LA.
    • ‘VAT’ is Value Added Tax.
    • ‘Website’ is Our online presence at https://www.boilersnbits.co.uk/.
    • ‘Your’ refers to the Buyer.
  2. References to statutes include any modifications, re-enactments, or rules made under them.
  3. Unless otherwise required:
    • Singular includes plural and vice versa.
    • Masculine includes feminine and vice versa.
    • References to persons include corporate or unincorporated bodies.
  4. Clause references are to clauses in these Conditions unless otherwise stated.
  5. Headings are for convenience and do not affect interpretation.

Basis of the Sale

  1. Submitting an Order creates a legally binding Contract with Us. You may withdraw from the Contract as per the Regulations, detailed in the Cancellation and Return Policy at Clause 10.
  2. The price of Goods, Shipping Charges, and applicable VAT are listed in the Order.
  3. The quantity, quality, and description of Goods are as specified in the Order (if accepted) and detailed on the Website.
  4. We will sell, and You will purchase, only the Goods listed in the Order. We may reject any Order, and sales are subject to these Conditions. We can amend Conditions with written notice to You.
  5. We will email You to confirm Order details after Payment Card authorization. This email is not Order Acceptance. Contact us if you don’t receive it within 1 working day.
  6. An Order is accepted only when the anticipated Delivery Date is confirmed by email.
  7. Order Acceptance is at Our discretion, typically if Goods are available, prices are current, the delivery address is in the Standard Delivery Area, and the Payment Card is authorized.
  8. Rejection occurs if Order Acceptance cannot be made. We will contact You to explain and suggest solutions.
  9. If Goods in the Order are unavailable, We may offer alternatives. You can reject the offer and receive a refund for the line price plus VAT.
  10. If the price of Goods increases after the Order Received Date, We may request additional Payment for the difference. You can cancel if You don’t accept the increase.
  11. Price increases do not affect accepted Orders.
  12. You are responsible for ensuring Order accuracy and providing necessary information for delivery and suitability in time for Us to perform the Contract.
  13. Check the Order carefully before submission. Contact us if you spot errors.
  14. You or We may withdraw from the Contract due to inaccuracies in Goods listed on the Website.
  15. We may change Goods’ specifications to comply with statutory or EC requirements.
  16. Variations to these Conditions are binding only if agreed by email or in writing.
  17. Errors or omissions in Our documents can be corrected if they don’t materially affect the Contract.

Price of Goods

  1. The price of Goods is as listed on the Website. We may change prices without notice.
  2. The price excludes Shipping Charges, detailed in the Price of Shipping Clause, shown in the Order.
  3. The total Order price includes applicable VAT.
  4. VAT is charged at 20%.
  5. VAT is calculated per line, including Shipping Charges.

Price of Shipping

  1. For deliveries in the Standard Delivery Area:
  • Shipping Charges vary by Fulfilment Channel and Option, clearly listed.
  • Charges are automatically calculated for Website Orders.
  • Surcharges may apply for postcodes AB, BT, GY, HS, IM, IV, JE, KW, PA, PH, ZE, at the Carrier’s rate. Contact us for details before ordering.
  1. We cannot automatically calculate Shipping Charges for non-Standard Delivery Areas. Contact us for a quotation. We may reject Orders if the Shipping Charge isn’t agreed in writing before Payment.
  2. Order changes may lead to recalculated Shipping Charges. We cover these if We initiate changes; You cover them if You do.
  3. Non-standard Delivery Service fees (e.g., Express, Next Day) are non-refundable.
  4. Re-delivery costs, due to failed initial delivery, are charged at the Carrier’s rate.

Promotions

  1. Promotions, like Promotional Codes or Special Offers, are subject to these Conditions unless an exception is agreed in writing.
  2. Promotional Codes must be valid and meet conditions (e.g., Basket value, specific products). They must exist in Our Information System and not be expired or terminated.
  3. Special Offers include price reductions, “buy 1 get 1 free,” or pack offers.
  4. Promotions have a 30-day Expiry Date from the Start Date, when first featured in print, email, or online.
  5. We may terminate Promotions at any time.
  6. Promotions are limited by stock or usage, offered on a first-come, first-served basis, and end when stock is depleted or usage limits are reached.
  7. Promotions are limited to one use per household or individual.
  8. Only one Promotional Code applies per Order, used once, and cannot be changed. Special Offers and Promotional Codes are independent.
  9. Promotions must be applied before placing the Order, not retrospectively.
  10. Promotions do not override other Conditions.
  11. We are not obligated to disclose current or upcoming Promotions.

Terms of Payment

  1. By submitting Payment Card details with the Order:
  • You confirm the Order information is accurate and You are authorized to use the Card.
  • You authorize Us to deduct the full price and any other due payments.
  1. If full payment cannot be obtained, We may:
  • Cancel the Order.
  • Suspend deliveries.
  • Recover delivered Goods.
  • Recover the cost of unrecovered or unsellable Goods.
  • Use Sinclair Goldberg Price Ltd for debt collection, with a 15% surcharge plus VAT and legal costs.
  1. For returns under the Cancellation and Return Policy, We will credit the Payment Card with the appropriate amount.
  2. Unless due to Our negligence, We are not liable for losses from fraudulent Payment Card use. You can cancel such payments and seek reimbursement from the Card Issuer.

Delivery

  1. The Carrier delivers Goods to the Order’s delivery address. Ensure the address is accurate.
  2. We will email the delivery date after Order acceptance. Ensure Your email address is correct.
  3. If the delivery date is unsuitable, contact us within 2 working days to rearrange. We will try to accommodate, but failure to agree doesn’t allow Contract repudiation. Deliveries within 1 working day cannot be rearranged.
  4. For multiple Goods, if partial delivery is possible, We will offer multiple delivery dates. Each delivery is a separate Contract. Issues with one instalment don’t allow repudiation of the entire Contract.
  5. We aim to meet the delivery date or, if none agreed, within 30 days of the Order Received Date, ensuring delivery within a reasonable period.
  6. If We fail to deliver due to reasons within Our control, reimbursement is limited to the Goods’ price, plus delivery and reasonable return costs.
  7. You may need to sign for delivery. Ensure someone is available to sign and check Goods. We cannot specify delivery timeslots. If delivery fails, We will arrange a new date.
  8. Check Goods on arrival. Do not accept visibly damaged Goods. Sign as “unchecked” if unable to inspect. Report damage immediately. You have reasonable time to inspect.
  9. Heavy or bulky Goods may need extra lifting facilities, which You must arrange.
  10. Do not arrange installation until Goods are delivered and checked. We are not liable for costs from late or failed deliveries.
  11. We may charge for re-delivery if the initial attempt fails due to inaccurate address details or Your unavailability.
  12. Either party can cancel the Contract for non-performance of delivery obligations. If We cancel, We refund payments and reasonable return costs.

Installation of Goods

  1. Do not install visibly damaged Goods, as installation implies acceptance in good condition. This doesn’t apply to faults not detectable by reasonable inspection.
  2. We are not liable for Goods damaged during installation by You or a third party.
  3. Post-installation, You or Your installer are responsible for identifying, repairing, or replacing faulty Goods.

Further Information Regarding the Delivery and Installation of Heating Appliances

  1. Check the Heating Appliance’s packaging for damage on delivery and report issues immediately. Do not open or tamper with packaging, per Your Duty of Care.
  2. Verify the product description on the packaging matches the Order. Report discrepancies immediately.
  3. A qualified Heating Engineer should confirm the Appliance’s suitability before opening packaging. Retain packaging until functionality is confirmed for safe return if needed.
  4. The Engineer should check for damage and readiness for installation. Report suspected damage immediately.
  5. After installation, the Engineer should test functionality:
  • If non-functional, ensure safety precautions and inform Us immediately.
  • If functional, register the Appliance with the Manufacturer for warranty benefits. Contact us if warranty details are missing.

Cancellation and Returns Policy

  1. You can cancel the Contract from Order placement until 14 days after the Delivery Date.
  2. For multiple Goods, cancellation is possible until 14 days after the last Delivery Date.
  3. Cancel by contacting us via Telephone or Email.
  4. If Goods are delivered, You must return them under these conditions:
  • We issue a Return Number and Return Address upon accepting Your cancellation.
  • You bear the cost and responsibility of returning Goods, unless We sent wrong or damaged Goods.
  • Return Goods within 14 days of receiving the Return Number, or the Number becomes void.
  • Do not return Goods without a Return Number or to another address, as this delays or voids returns.
  • Your Duty of Care requires returning Goods complete, undamaged, with accessories, instructions, and reasonable packaging. You are liable for the full price of non-compliant returns.
  1. Refunds are issued within 14 days of receiving returned Goods. Keep proof of postage. For cancellations before dispatch, refunds are issued within 14 days of the request.
  2. Shipping charges are refunded only for full Order cancellations. Partial cancellations don’t qualify for proportional refunds. Enhanced Shipping charges are non-refundable.
  3. Exemptions:
  • Personalised Goods cannot be cancelled.
  • We cannot accept returns or liability for Personalised Goods made to incorrect specifications.
  • Goods with tampered or broken Security Seals cannot be cancelled, including:
    • Digital/electronic equipment like Smart Heating Controls with recordable memory or registrable software.
    • Printed Circuit Boards in electrostatic protective wrapping.

Risk and Property

  1. You are responsible for the Goods’ condition upon delivery by the Carrier.
  2. Ownership of Goods remains with Us until full payment is received, despite delivery or risk transfer.

Warranties and Liability

  1. These Conditions don’t affect manufacturer warranties, which are separate from this Contract. Refer to the manufacturer’s guarantee for details.
  2. Your statutory rights for defective Goods or losses due to Our negligence or failure are unaffected. Contact Trading Standards or Citizens’ Advice Bureau for more information.
  3. Time Limit for Claims:
  • Inspect Goods promptly after delivery. Notify Us of defects or specification issues within 2 working days of delivery, or within a reasonable time if not immediately apparent.
  • Valid claims within 2 working days allow rejection and a full refund or replacement.
  • Claims after 2 working days or beyond a reasonable time may result in replacement or partial refund at Our discretion, with no further liability.
  1. We are not liable for loss or damage, except for death or personal injury due to Our negligence, if:
  • There’s no breach of Our legal duty of care.
  • The loss isn’t a foreseeable result of a breach.
  • Increased loss results from Your breach.
  1. For commercial delivery addresses, We are not liable for loss of profits or economic loss from a breach.
  2. We are not liable for delays or failures due to unforeseeable factors, subject to Regulations.
  3. Website information (e.g., descriptions, specifications, images, prices) is provided with care but may not be perfect. Images are illustrative, and We are not liable beyond these Conditions for errors or outdated information.
  4. The Website’s compatibility with all systems or browsers is not guaranteed. We are not liable for losses from incompatibility, to the extent permitted by law.
  5. We are not responsible for manufacturer-hosted content (e.g., PDFs, guides, brochures).
  6. We are not responsible for linked websites’ content.

Waste Electrical and Electronic Equipment

  1. We offer free recycling of Waste Electrical and Electronic Equipment (WEEE) on a like-for-like basis when You buy new Electrical or Electronic Equipment (EEE).
  2. Notify Us within 7 days of purchase to deliver WEEE to Us. If accepted, We provide a Recycle Number and Recycle Address.
  3. WEEE without a valid Recycle Number or sent to another address cannot be accepted.
  4. You bear the cost of delivering WEEE to Us. We don’t offer collection.
  5. Alternatively, dispose of WEEE at civic amenity sites (visit www.recycle-more.co.uk) or check the Environment Agency website.

Force Majeure

  1. We are not liable for failure or delay in Contract obligations due to events beyond Our control, including:
  • Nuclear, chemical, or biological disasters.
  • Severe weather.
  • Terrorist attacks, war, riots, or civil disturbances.
  • Fire, explosion, storm, flood, earthquake, epidemic, or natural disasters.
  • Transport inaccessibility.
  • Telecommunications or internet failures.
  • Utility service interruptions.
  • Supplier or subcontractor delays.
  • Government actions.
  1. Performance is suspended during a Force Majeure Event, with a time extension. We will try to resolve or find solutions. If the Event exceeds 7 days, We may cancel the Contract.

Entire Agreement

  1. The Contract, including these Conditions and referenced documents, is the complete agreement, superseding prior discussions or agreements.
  2. Neither party relies on representations or warranties not in the Contract, with liability limited to breach of Contract.
  3. This clause doesn’t limit fraud liability or consumer rights.

Waiver

  1. Failure to enforce Your obligations or exercise Our rights doesn’t waive them. A waiver of a default isn’t a waiver of future defaults. Waivers must be explicit and in writing.

Law and Jurisdiction

  1. Disputes will be resolved quickly. Court proceedings must be in the UK.
  2. Disputes or claims are governed by English Law, subject to the non-exclusive jurisdiction of England and Wales courts.
  3. Invalid or unenforceable provisions don’t affect other provisions or their enforceability elsewhere.
  4. No third-party benefits are conferred under the Contract.

Communications

  2. Electronic communications:
  • Are sent when they leave the originator’s control.
  • Are received when they enter the recipient’s accessible system in readable form.
  • Are dispatched from a business’s principal place or an individual’s residence.
  • Are received at the same.
  • Retain delivery receipts and correspondence for Your records.
  1. Posted communications are deemed received three days after first-class mailing or five days after second-class.

Privacy

  1. We won’t share Your personal information unless required by law or to perform Our duties. We use Your data to:
  • Provide Goods.
  • Process Payment.
  • Inform You of offers and promotions.
  1. Unsubscribe from offers via email links.
  2. The Website uses Cookies; see Our Cookie Policy.
